An action for damages taken by a former security man who was attacked and seriously injured when a gang raided the Semperit tyre plant at Ballyfermot, Dublin, has been settled, the High Court was told yesterday.

Mr Richard McGarr, a father of three, of Cushlawn Park, Tallaght, Co Dublin, told Mr Justice Johnson that in the attack on March 26th, 1992, his skull was fractured, leaving him with speech difficulties. He could remember little of the hold-up and could recall only waking up in hospital afterwards.

He said he now had severely limited reading and writing ability, his concentration was very limited and he suffered headaches, depression and anxiety.

His action was taken against Corporate Security Ltd and Semperit Ireland Ltd and opened before the High Court last week. Both defendants denied negligence.

On the third day of the hearing yesterday, Mr Padraig McCartan SC, for Mr McGarr, said the matter was settled. Mr Eamon de Valera SC, for Semperit, said the issue of liability was still "at large" between the two defendants. Mr Justice Johnson granted counsel's application to adjourn the liability issue and put it in the court list for mention at a later date.
