Lawyers for the Tánaiste and Progressive Democrats leader, Ms Mary Harney, have today been granted leave from the High Court to seek an injunction against MagillMagazine.
In today's issue of MagillMs Harney's links to a number of property developers and planning decisions she made while a Dublin County Councillor, are examined.
Vincent & Beatty Solicitors, acting for Ms Harney, said in statement this morning: "The basis of the article is that an order has been served on Ms Harney by the Flood Tribunal requiring her to make disclosure of all finances, sources of income and bank accounts dating back over the past twenty years covering all contributions, donations or payments either directly or indirectly made to her during the period she served as a county councillor with Dublin County Council.
"This statement like so much else in the article, is utterly untrue and without any foundation whatsoever. No order has been made by the Flood Tribunal against Ms Harney."
The law firm also said Ms Maire Ann Howard, solicitor for the Flood Tribunal, had confirmed that "no order of any nature wahtsoever has been made by the Flood Tribunal against Ms Harney".
Ms Harney refused to answer questions about the affair at a PDs news conference today.
However this afternoon at the High Court, Ms Harney’s sought an order for an injunction to prevent further publication of the article.
The Minister's legal team said the continued publication of the material would cause irreparable damage "at a very sensitive time" for Ms Harney and her electoral prospects, and her party.
The injunction application will be heard tomorrow.
Ms Harney has also taken a separate action against the publishers of the magazine.
