A teenage girl is to receive €700,000 in settlement of her High Court action over a shoulder injury allegedly suffered due to negligence at birth. The settlement was made without admission of liability.

Aoife James (14), Douglas, Cork, had through her mother Carol sued a consultant obstetrician, Patrick Kieran, of the Cork Clinic Western Road, Cork.

It was claimed Aoife suffered personal injuries as a result of alleged negligence at the time of her birth in 1998.

It was claimed she suffered permanent right-sided Erbs Palsy, and has had two operations to relocate her shoulder along with physiotherapy. It was further claimed her right upper limb is severely functionally compromised and her life quality is severely diminished as a result.

The claims were denied and Ms Justice Mary Irvine was told yesterday the case had been settled with no admission of liability.

Dr John O’Mahoney SC, for Aoife, said she is a precious member of her family, with four brothers. She has difficulty with fine movements like washing and drying her hair.
