Two construction companies which faced charges arising from the death of a construction worker during the building of the €1 billion M3 motorway in 2008 have been found not guilty by direction of Judge Ray Fullam at Trim Circuit Court.

Peter McAndrew, a 44-year-old pipe-layer who was originally from Lahardane, Ballina, Co Mayo, was fatally injured when the dumper he was driving overturned into a gully at Derrockstown, Dunshaughlin, on September 22nd, 2008.

Mr McAndrew, a father of four, had been living at Coolarty, Co Longford.

SIAC Construction, Clondalkin, Co Dublin, and Ferrovial Agroman Ireland Ltd, Damastown, Dublin, denied charges brought under the Safety Health and Welfare at Work Act 2005.

Following 12 days of evidence from 30 witnesses and two days of legal argument, Judge Fullam ruled there was insufficient evidence on which a jury properly charged might reach a guilty verdict regarding whether safe systems of work were being complied with.
