An action by a twin boy suffering from cerebral palsy against the South Eastern Health Board, alleging negligence in the circumstances of his birth, has been struck out at the High Court.

The action by Gary Kavanagh will now proceed tomorrow as an assessment of damages only, against obstetrician, Dr Harry Murphy.

The proceedings which opened last week before Mr Justice O'Donovan were brought by Gary, now aged eight, suing by his mother, Mrs Patricia Kavanagh, of Curracloe, near Wexford town.
