Murder accused refused permission to travel to Spain

A man charged with murdering his partner’s son has been refused a bail application to travel to Spain.

David Mahon is charged with murdering 23-year-old Dean Fitzpatrick on May 26th, 2013 at Northern Cross on Dublin’s Malahide Road.

The 44-year old from Ongar Village, Clonsilla, appeared at the Central Criminal Court on Friday where he applied to have his bail conditions varied to allow him to take a two-week trip to Spain.

Under his bail conditions, Mr Mahon must sign on at a Garda station three times a week and relinquish his passport.

The court heard Mr Mahon had been granted a similar application that allowed him to travel to Spain in September but Ms Justice Margaret Heneghan refused on this occasion.

Detective Sergeant Eddie Carroll of Coolock Garda station told Justice Heneghan he was concerned Mr Mahon is a flight risk.

Ms Justice Heneghan said that she was taking into account Det Sgt Carroll’s concerns that the trial is now near to starting and that this heightened the flight risk.

“I am not disposed to grant his bail request based on what I have heard at this point,” and added that he is free to make a further application.

Mr Mahon’s trial is due to start in April 2016.
