The High Court has issued an order preventing construction of a road over part of a wooded area at a housing estate in Kilkenny. The roadway was intended to provide access to a proposed development of 65 houses.

Mr Justice Quirke granted the order in favour of four residents of a housing estate at Ashurst, College Road, Kilkenny, who had argued that the wooded area between their estate and the adjoining lands at Walkinslough, on which the proposed development was intended to be built, should be preserved as an open wooded area and general amenity for the Ashurst residents.

The order was sought by Mr Jean and Ms Mary Fortin and by Mr Christopher and Ms Daphne Phelan, of Ashurst, a development of 17 houses with an open space and mature trees.

The order is against Ms Mary Delahunty, Cootes Lane, College Road, Kilkenny.
