A compromise was reached in the High Court yesterday during the hearing of an injunction application by the Dublin North Socialist Party candidate, Ms Clare Daly, against the Fingal Independent newspaper.
Ms Daly brought an application before Mr Justice McCracken for an interlocutory injunction directing that all editions of the Fingal Independent dated March 6th be removed from public sale.
Ms Daly objected to an article which she claimed alleged she had said she would not win the election or indicated she favoured second preferences going to the Labour Party candidate, Mr Sean Ryan.
The article complained of has already been published. However, under the agreement reached yesterday, the newspaper has agreed not to republish the same material again before close of polls on Wednesday next.
It is effectively holding off distribution of next week's edition until after close of polls, which means it will not distribute the newspaper until Thursday morning.
During yesterday's hearing, the judge granted an adjournment. Following discussions between the sides, an order stating the newspaper will refrain from publishing matter complained of was made by consent.
