College examiner "wishes to resign"

THE examiner appointed to the Advanced Technology College, Merrion Square, Dublin, wished to resign as all potential investors had pulled out and there was no prospect of the company surviving, the High Court was told yesterday.

Mr Lyndon MacCann, counsel for the examiner, Mr Ruairi O'Farrell, told Mr Justice Shanley that there had been a considerable interest by investors, but all had now pulled out.

The examiner, appointed by the High Court on March 21st, said there was now no prospect of the company surviving as a going concern. Mr O'Farrell wished to resign. It was expected that there would be an application on Tuesday for the company to be wound up, said Mr MacCann.

Mr Justice Shanley said the petition for the appointment of the examiner was presented by a group of students and not the company. The students had a clear interest and would have to have the opportunity to express their views. He would put the matter in for Tuesday as maybe the students would want to consider the matter.
