The Supreme Court has cleared the way for the extradition to Poland of a man on charges of alleged sexual abuse of a teenage girl.

The three-judge court yesterday granted the Minister for Justice’s appeal against the High Court’s refusal to make an order for the surrender of Jaroslav Piotr Gotszlik.

In the High Court in November 2007, Mr Justice Michael Peart refused extradition because of the existence of two separate warrants for each of the offences from Poland, which he held was contrary to the provisions of section 22 of the European Arrest Warrant Act.

Yesterday in the Supreme Court, Ms Justice Susan Denham, presiding, said the European Framework Decision on European Arrest Warrants “could not be constructed as requiring all offences to be on a single warrant”.

No prosecution in Garda crash case

The DPP has directed no prosecutions in the case of a seven-year-old boy who died after he was struck by an unmarked Garda car in Finglas, Dublin last year, writes Georgina O’Halloran.

Dean Ward, of Carrigallen Drive, Finglas died after he was hit by the vehicle while crossing the road with his brother near the Clearwater shopping centre, on March 8th.

The Garda Ombudsman Commission carried out an investigation following the fatal incident. Senior investigating officer with the commission Darren Wright told Dublin City Coroner’s Court yesterday that a file was submitted to the DPP and there are to be no prosecutions.

The inquest into the boy’s death was adjourned until May.

Closing speeches in rape trial

The trial of a man accused of raping and threatening to kill a newly-arrived fellow national from Latvia has reached closing stages at the Central Criminal Court.

The 32-year-old accused, has pleaded not guilty to three charges of rape, oral rape and a threat to kill a then 19-year-old woman near Dublin city centre on November 10th, 2007. The jury will hear closing speeches by prosecuting and defence counsel.

Two men had 600,000 drugs

Two Mullingar men have admitted possession of drugs estimated to have a street value of over €600,000.

At Dublin Circuit Criminal Court Kevin Bardon (21), of Greenview Terrace, Patrick Street, and Michael Skey (32), of Grange Crescent, pleaded guilty to possession of cannabis resin for sale or supply at Nephin Road, Cabra on August 2nd last. The men were remanded in custody with consent to bail until their sentence date in July.

Three years for violent disorder

A teenager has been sentenced to three years detention for his role in a gang whose violent attack on UCD architecture student Philip King led to him being thrown from a window on the top deck of a Dublin bus.

Michael Tyser Connors (19), of Daletree Place, Daletree Estate, Ballycullen and his three co-accused pleaded guilty at Dublin Circuit Criminal Court to violent disorder at Belgard Square West on October 20th, 2006.

A 17-year-old co-accused received three years detention suspended and the remaining two youths will be sentenced later.
