A DISPUTE between two accountants over which of them has been validly appointed as liquidator to a transport company has been adjourned by the High Court to a date in September.
Last week the High Court granted chartered accountant and insolvency practitioner John O’Connell a temporary injunction preventing Peter Russell, also a chartered accountant and insolvency practitioner, of Russell Co Trinity House, George’s Quay, Cork city, from acting as liquidator of Managh International Transport Ltd.
In his proceedings, Mr O’Connell, of Bank Place, Mallow, Co Cork, is also seeking a declaration from the court that he is the liquidator of the company.
However, the company’s directors dispute Mr O’Connell’s claim and have brought a motion seeking a declaration from the court that Mr Russell be confirmed as liquidator.
Yesterday, at a duty sitting of the court, Ms Justice Mary Laffoy was told the injunction could be lifted as both Mr Russell and Mr O’Connell had given an undertaking not to act as liquidator of the company until all matters have been determined by the courts.
The judge adjourned the case to a date in September.
