The domiciliary midwife at the centre of a dispute with An Bord Altranais will be in the High Court again today seeking the modification of an injunction which would allow her to deliver five more babies. This is in spite of an interim injunction preventing her from practising.

The interim injunction was granted to An Bord Altranais on August 1st last, and effectively prevented Ms Ann Kelly from practising as a midwife pending the hearing of a Fitness to Practise inquiry by the board. Her lawyers sought to have the injunction lifted in October. While Mr Justice Moriarty allowed it to continue, he modified it to allow 14 women, who were represented separately in court, to continue to receive her care. Judge Moriarty said if others wished to avail of her services they could apply to the court. This is what is happening today.

Meanwhile, Ms Kelly is seeking a judicial review of the proceedings undertaken by An Bord Altranais. A date has been set for the end of January next.
