A MAN has gone on trial at Derry Crown Court charged with the false imprisonment, assault, indecent assault and rape of a 45-year-old woman in his home in Derry almost two years ago.

Patrick McNamee (34), originally from Ennis, Co Clare, is alleged to have committed the offences in his house at Ardanlee in the Culmore area of Derry on September 9th, 2008. He told the police sex with the complainant was consensual.

Jackie Orr, prosecuting, said the woman and the defendant met outside a city bar and agreed to share a taxi. After stopping at a takeaway, the taxi was driven to Ardanlee rather than to the woman’s home in the Waterside area.

Ms Orr said when the defendant brought the woman into his house, his mood changed and he locked the front door with a chain. He forced her to an upstairs rear bedroom, partially hung her out the window, and told her to look at the concrete below. “He said to her that is where you will end up with your neck broken,” Ms Orr said.

She said the defendant then pulled the woman on to the bed, where he raped and abused her.

He then went to the bathroom and the woman managed to escape. The defendant ran after her and banged her head off a wall, but the commotion disturbed neighbours who alerted the police.

The defendant told police one instance of consensual sex took place.The trial, expected to last three weeks, continues.
