The Taoiseach, Mr Ahern, told the Dail today speculation in the media on the reasons for the resignation of Mr Justice Flood from the planning tribunal was "incorrect".

Mr Ahern told members of the Dail they had Mr Justice Flood's letter of resignation and should accept his decision.

The Taoiseach responded to questioning from the Fine Gael leader Mr Enda Kenny by saying the issue of costs would remain a matter for the tribunal.

He said there was "no problem with the tribunal continuing its work." He added that the costs issue requires legislation which will be provided in the autumn.

The Labour leader Mr Pat Rabbitte, told the Dail: "I am sure the Taoiseach agrees with me that if the taxpayer ends up paying €10.5 million in fees down the road for Ray Burke, there will be outrage".He also said the Taoiseach was drip feeding information on the matter, after Mr Ahern admitted in the Dail he was aware of Mr Justice Flood's intention to resign on May 26th, a month before he announced he was stepping down.Mr Justice Flood resigned with immediate effect on Friday 27th June.
