A COURT row over a move to reopen a disciplinary hearing against three Galway hurlers has been settled, the High Court heard yesterday.

Conor Dervan, David Glennon and John Rafferty of Mullagh in Galway, got a temporary injunction on Monday preventing the Galway County Board entering into a disciplinary process to suspend them in relation to an alleged assault on a referee last year.

Yesterday, solicitor Carthage Conlon, for the three men, said the matter had been resolved.

The proceedings arose out of a match between Mullagh and Loughrea on October 18th last year when it was alleged referee Christy Helebert was assaulted. As a result of the alleged incident, all three Mullagh players received 12-week bans which were served.

However, the GAA’s Central Competitions Control Committee (CCCC) then raised concerns about the way the first hearing was handled by the Galway County Board and directed the matter be reheard.

Counsel for the three told the court on Monday it appeared the CCCC wanted to enforce the maximum penalty of 48 weeks which such offences can attract. The CCCC’s actions were an unlawful interference with the original disciplinary hearing, it was claimed.
