A WOMAN has been given permission by the High Court to sue a foreign company over injuries she claims she sustained when she was allegedly thrown from a toboggan while holidaying in Lapland.

Catherine Duff, Greenfort Gardens, Clondalkin, Dublin, is seeking damages against travel agent Budget Travel; tour operators Mardan, Wexford Street, Dublin; and the company that supplied the toboggan, Arctic Circle Tours, Kangaspelto, Rovaniemi, Finland. All three companies deny liability.

Refusing the application by Arctic Circle Tours to set aside the action as an Irish court did not have jurisdiction under EU regulations, Ms Justice Elizabeth Dunne yesterday said there was a prima facie case to be made. She said it was clear the two tour companies were involved in arranging the toboganning trip as they had provided a coach to take Ms Duff to the ski centre where the accident happened.

Ms Duff alleges her toboggan struck something, causing her to be thrown off and hit a tree stump, sustaining severe injuries. She says the defendants were negligent in failing to provide adequate training, failing to adequately supervise her and failing to provide a safe toboggan and track.
