A FITNESS therapist’s former bosses at Curves had “bent over backwards” to allow her set up her own business, a judge said yesterday.

Judge Leonie Reynolds was told in the Circuit Civil Court that ex-Curves manager Áine Crossan was now successfully running a chronic pain management and rehabilitation clinic at Studio 23 on Dublin’s Dame Street.

Ms Crossan, of St Joseph’s Street, Dublin, failed in a claim for wrongful dismissal against Figure Tone Ltd, Terenure Place, Dublin, which ran a number of Curves slimming franchises throughout the State.

Judge Reynolds also dismissed a claim by Ms Crossan for €6,000 in allegedly unpaid bonuses.

She also threw out a counter claim by Figure Tone Ltd in which it was alleged she had conducted her own Pilates class while employed by Figure Tone.

Judge Reynolds told barrister Dermot Cahill, for Figure Tone Ltd, that Ms Crossan had a close personal relationship with Figure Tone directors Morgan Pierce and Martina Brady who had bent over backwards to help her set up on her own.

She said it was regrettable there had been no written contract regarding Ms Crossan’s employment at the Clontarf club and would make no order as regards payment of legal costs.
