The National Authority for Occupational Safety and Health and a contracting company have reached a partial agreement regarding a site at Swords, Co Dublin, the High Court was told yesterday.

Last week, the authority secured a temporary order prohibiting Seaview Castle Contracts Ltd from using the site until specified measures were taken to reduce the risk to the safety and health of persons at the Harp Inn development, North Main Street, Swords, to a reasonable level.

The project includes the construction of 52 apartments and a hotel complex.

When the case came before Mr Justice McCracken yesterday, Mr Fergal Foley, for the authority, said that the sides had reached partial agreement.

By consent, the interim order could be varied to allow a safety consultant to go on site and prepare a health and safety plan and to allow remedial works to take place, subject to the approval of the authority.

Mr Hugh Mohan SC, for the company, said it was hoped the sides would have reached further agreement by Friday. The case was adjourned until then.
