An order has been made by Mr Justice Paul Carney directing the appearance before him at the Central Criminal Court of a medical expert in the case of a Wexford man who raped his younger sister.

He made the orders after defence counsel said the medical expert was refusing to forward an assessment of his client, which had been ordered by the court, unless payment was made in advance.

Barrister Colman Cody told the judge he was becoming concerned because his client was due to be sentenced soon and the medical report was essential for the defence.

Mr Justice Carney also directed the expert to bring all the relevant papers and notes in the case to court.

The 22-year-old man has pleaded guilty to one count of raping his sister on a date unknown between September 16th and December 15th, 1999 and has been remanded in custody. The guilty plea to that single count was without prejudice to further counts on the indictment.

Mr Justice Carney has also directed the preparation of victim impact and probation reports as well as the medical assessment.
