Engineer's claim for damages rejected

A drainage expert, who turned his back on the use of protective gear, suffered a chemical face wash, a judge heard yesterday.

Judge Jacqueline Linnane told drainage engineer Paul Monaghan that if he had worn the protective clothing provided for him he would not have suffered superficial burns to his face.

She dismissed a €38,000 damages claim by Mr Monaghan, of Naas Road, Inchicore, Dublin, against Heuston Railway Refreshments Rooms Ltd, which trades as The Galway Hooker at Heuston Station.

Judge Linnane ordered Mr Monaghan to pay the restaurant's legal costs.

The Circuit Civil Court heard the restaurant had attempted to clear a drain blockage with a bucket of Sewer Magic which contained a chemical. Mr Monaghan, who was employed by All About Drains Ltd, put a power hose down the drain and there was a splash-back of chemicals into his face.
