Boy wins 40,000 in damages for injury after falling on glass

A boy who injured his hand when he fell on broken glass while playing outside his home has secured €40,000 in settlement of his High Court action against Dublin City Council over its alleged failure to keep the footpath clean. Nathan Clarke, now aged 16, Coultry Road, Ballymun, suing through his father Joseph, brought the proceedings arising out of the incident on July 6th, 2001, which occurred when he was aged seven. Liability was admitted and Mr Justice John Quirke yesterday approved the damages and directed the money be lodged in court until the boy is aged 18. The boy had suffered extensive injuries to his left hand and underwent surgery in Temple Street Children’s Hospital, his counsel told the court.

A five-judge Supreme Court will next February hear an appeal by a lesbian couple against a High Court ruling that they do not have the right to marry under the Constitution. Dr Katherine Zappone and Dr Ann Louise Gilligan previously said they believed clarification by the Supreme Court of the issues raised in their action was not only in their own interest but also in the public interest. The case was mentioned yesterday before the Chief Justice, Mr Justice John Murray. Michael Collins, for the couple, said his side’s written submissions would be filed by December 21st and the State’s by the end of January.

Man to appear in court over EBS raid

A man is due to appear before Blanchardstown District Court this morning in connection with a raid on a building society in Leixlip.

The incident occurred in the EBS on Mill Lane in Leixlip, shortly after 9am yesterday, when the man, armed with an axe, confronted a female staff member and demanded cash. He fled empty-handed and was arrested by gardaí a short distance away.

The staff member was not injured in the incident.

The 41-year-old man was detained under Section 4 of the Criminal Justice Act 1984 at Leixlip Garda station. He will be held in custody pending court appearance.
