AN 11-YEAR-OLD girl who suffered a broken index finger when she slipped and fell in the car park of the Dundrum Town Centre in Dublin has been awarded €15,000 damages.

Denise Ryan fractured the finger on her right hand only weeks before the world championships for majorettes in Germany.

Counsel for Denise, John Doherty, told the Circuit Civil Court yesterday that she injured her hand when she slipped and fell at Dundrum Town Centre in March 2008.

He told Circuit Court president, Mr Justice Matthew Deery, that such was the determination of Denise that the injury had quickly healed in time for her to participate in the championships.

Mr Doherty said Denise, of Herberton Drive, Rialto, Dublin, had been shopping with her parents in the Dundrum centre when she slipped on a wet floor. He said liability in her claim for damages had not been contested by the defendants, Progressive Car Parks Ltd, Avondale Business Park, Carysfort Avenue, Blackrock, Co Dublin.

Mr Doherty said Denise had been treated at St James’s Hospital, Dublin, where the fractured index finger of her right hand had been strapped to the middle finger.

“Denise made a good and very quick recovery and was able to participate in the world championships.

“I am recommending the court’s approval of a €15,000 settlement offer by the defendants,” Mr Doherty said.

Mr Justice Deery said the offer was appropriate.
