A dispute between rival gas companies over the use of trademarked gas cylinders is to be heard in the Commercial Court later this month. Flogas Ireland Ltd has brought the action against Tru Gas Ltd, which denies the claims.

At a hearing before Mr Justice Peter Kelly yesterday, counsel for Tru Gas Ltd said it was prepared to undertake, pending the outcome of the case, not to fill or procure any cylinder bearing the name of Flogas and not to modify or re-badge any Flogas cylinders which may be in its possession. The judge agreed to make a number of interim orders to address concerns of Flogas. Flogas claims Tru Gas Ltd has been engaged in acquiring and holding substantial quantities of Flogas cylinders.
