A prosecution relating to an alleged incident at Garvaghy Road, Portadown, Co Armagh, on July 11th last year ended unexpectedly at Craigavon Magistrates Court yesterday.

The defendant, Mr Eamon Anthony McCann (36), of Woodside Hill, Portadown, had denied a charge of riotous behaviour at or about Garvaghy Road.

The decision hinged on the question of admitting in evidence a BBC Northern Ireland video taken at Garvaghy Road.

Mr John Kearney, defending, contended that because neither the photographer nor the cameraman was in court to authenticate the material, the evidence should not be admitted. He said it was necessary to know when and where the original video was taken.

After lunch, the DPP lawyer indicated that the Crown was prepared to withdraw the case.
