A garda has said she saw a female colleague show a piece of paper when asked for a warrant by the mother of a young man accusing four gardaí of assault.

Garda Katherine Patterson, then a student garda, told Tom O’Connell SC, prosecuting, that she saw Garda Claire Delaney hold up a piece of paper at the door of a Basin Street flat answered by Fidelma Gaffney, who asked about a warrant.

She said the three other accused, Garda Seán O’Leary, Garda Alan Conlon and Garda Eoin Murtagh, then went upstairs, followed by Garda Delaney and herself.

She could not see into a bedroom, but heard moaning from inside. She saw Garda Conlon come out and switch places with Garda Murtagh.

Garda O’Leary, Garda Murtagh, Garda Conlon and Garda Delaney have pleaded not guilty to forcing entry at Basin Street Upper, Dublin, entering as a trespasser and assaulting Owen Gaffney (21) on February 17th, 2008.

Garda Murtagh, Garda Conlon and Garda Delaney have pleaded not guilty to falsely imprisoning Ms Gaffney.

The trial continues.
