DPP challenges magistrate

A resident magistrate is being taken to court by the North's Director of Public Prosecutions

A resident magistrate is being taken to court by the North's Director of Public Prosecutions. Mr Robert Porter RM is believed to be the first magistrate to have his decision challenged by a High Court application for judicial review.

The DPP, Mr Alasdair Fraser QC, has brought proceedings over Mr Porter's decision at Strabane Magistrates' Court last May when he deferred sentence until November on Terence McElroy, of Townsend Terrace, Strabane, on 146 motoring offences.

The DPP is seeking a declaration that Mr Porter acted unlawfully as he had previously deferred sentence on November 28th, 1996.
