Diageo wins miniature Baileys case

Diageo won the right today to sell miniature bottles of Baileys across the European Union.

Diageo won the right today to sell miniature bottles of Baileys across the European Union.

The European Court of Justice ruled that Germany's liquor industry umbrella group was wrong to ban the world's biggest spirits group from selling its small helpings of blended Irish whisky and cream simply on the grounds of size.

The EU's top court said a section of EU law that excludes packaging of 0.071 litres from a list of permissible sizes was invalid.

The court said it interpreted the relevant EU rules in light of their aim - to uphold the bloc's basic tenet of free movement of lawfully made goods.

Consumers were still protected as other EU rules required manufacturers to display the volume and unit price on the product, the court said.

Supporters of Britain's traditional measurements may also see the ruling as a victory, with 0.071 being equivalent to an eighth of a pint.
