Circuit Judge Larry Seidlin wept as he announced a surprise decision In Fort Lauderdale, Florida, to give custody to Richard Milstein after six days of bitter bickering and testimony from Smith's estranged mother, Virgie Arthur, and her boyfriend, Howard K Stern.

Stern wanted to bury Smith next to her son in the Bahamas, while Arthur wanted her back in the family plot in her native Texas.
