County boxing board used IABA funds unlawfully

THIRTY-ONE MEMBERS of the Dublin County Amateur Boxing Board have been told by a judge to pay a €60,000 bill for costs arising out of an unsuccessful legal case against their parent body, the Irish Amateur Boxing Association.

Caroline Costello SC told the Circuit Civil Court that three years ago the 31 defendants failed in the High Court to restrain a decision of the IABA to change its status to that of a limited company.

Ms Costello, who appeared with Edward Farrelly for the association, said costs of €34,200 had been awarded against them and had unlawfully been paid out of the Dublin County Board’s IABA funds.

Circuit Court president Mr Justice Matthew Deery granted the association judgment for €34,200 on the grounds IABA funds had been misapplied to pay the costs bill. He also directed the members to pay the Circuit Court costs, estimated at more than €25,000.

Mr Justice Deery said there was no power under the rules of the association to pay the legal costs of the 2008 High Court action taken by the county board and he ruled that the funds had been misapplied.
