A former art teacher who alleged he was left semi-paralysed down his left side after brain surgery has settled his High Court action against St Vincent's Hospital, Dublin, and a doctor.

The terms of settlement were not announced in court.

Mr John Rooney (45), of Keenaghan, Carrick-on-Shannon, Co Leitrim, had sued the hospital and Mr Fergus Donovan, who carried out brain surgery on him.

Both defendants denied negligence and the court was told the settlement was made without admission of liability.

It was alleged during the hearing that Mr Rooney was left greatly handicapped after the operation for the removal of an enlarged blood vessel, performed at St Vincent's on April 23rd, 1987.

Before the operation, Mr Rooney was stated to have suffered from delirium in his sleep and sleep-walking.

In evidence, Mr Rooney said he was left semi-paralysed down his left side as a result of the operation.

He said he had lost his job as an art teacher following the operation and his weekly income was £75.50 disability allowance.

In court yesterday, Mr Garrett Cooney SC, for Mr Rooney, told Mr Justice O'Donovan the action had been settled and could be struck out.
