An action by a Co Kerry doctor and his wife who claimed they could not enjoy their garden because of the danger of being hit by golf balls from Ballyheigue Castle Golf Club was settled at the High Court yesterday.

The case was struck out after Mr Justice O'Higgins was told by Mr David Hardiman SC, for the club, that agreement had been reached between the parties.

Dr Sean Quill and his wife Anne, of Castlelawn, Ballyheigue, had sued the club and a neighbour, Mr Daniel Mulvihill.

The Quills alleged Mr Mulvihill had allowed users of the club to gain access to the course over an alleged private road.
