Mr James Gogarty said he had left McInerneys where he worked from 1954 to 1956 quite amicably and denied that he had had a protracted battle with the company over six years after he left.

Mr Colm Allen SC, for Baileys and Bovale Ltd, asked how the relationship with McInerneys terminated. Mr Gogarty replied: "First class."

Asked in what circumstances he left, Mr Gogarty said he had said "First class" because it was quite amicable. Mr Allen asked: "You had no row with McInerneys between 1954 and 1956?"

Mr Gogarty replied: "Not in 1954 to 1956, no never." Asked if he had ever had a row with McInerneys, he said he had not.

Mr Allen said: "So it would be wrong to suggest that you had a protracted battle with McInerneys spreading over a period of six years after you left McInerneys."

Mr Gogarty said that would be incorrect.

Mr John Gallagher SC, for the tribunal, said that if other evidence to the contrary was going to be adduced, it should be put to the witness so he had an opportunity to deal with it.
