Trustee in Drumm case seeks to engage lawyers

THE INTERIM trustee appointed in the US to the bankruptcy case initiated by former Anglo Irish Bank chief executive David Drumm yesterday sought the permission of a judge there to engage lawyers because of the case in Ireland involving a valuable house in Malahide, Co Dublin.

Kathleen Dwyer has asked permission of Frank Bailey, bankruptcy judge in Boston to appoint law firm Hanify King as her special counsel.

Although Mr Drumm, who filed for bankruptcy on October 14th, has not yet filed a statement of his financial affairs, Ms Dwyer said she has been informed of a case being taken by his former employer, the judge was told.

Anglo has asserted claims for more than €8 million in unpaid loans and Mr Drumm has counterclaimed for more than €2 million for alleged accrued and unpaid employment benefits, Ms Dwyer said.

Mr Drumm “maintains an interest in parcels of property located in Massachusetts and Ireland. Upon information and belief [Mr Drumm] may have transferred his interest in the Ireland property to his spouse for less than fair consideration and the bank secured an order restraining any further transfer of such property.”

The matter is due to feature in a court hearing in Ireland on October 26th, the judge was told in a filing. Ms Dwyer said she would need the assistance of counsel to help her with the issue.

Ms Dwyer was appointed soon after Mr Drumm’s petition and will preside over any meeting of creditors.
