The High Court has refused to appoint a provisional liquidator to a window- manufacturing company where some former workers have conducted a sit-in.
A supplier of Hele Windows Ltd, Midleton, Co Cork, Ireland’s first PVC window manufacturer, had petitioned to have a provisional liquidator appointed.
Profile Systems Holdings claims it is owed €93,000 for services supplied to the Hele facility at Owenacurragh Business Park, Knockgriffin, Midleton.
Ms Justice Mary Laffoy, who remarked there were questions about the motives for the petition, dismissed it after being informed Hele had passed a resolution to go into voluntary liquidation.
In affidavits, Profile Systems said it feared assets were being dissipated, books and records were being removed and it was concerned Hele was taking deposits from customers for works it could not complete.
Hele’s lawyers said some books and records were taken home in order to prepare a list of all of the firm’s creditors.
Directors Natalie and Tanja Lentzy were prepared to offer undertakings that assets would not be dissipated and all books and records would be made available to any liquidator appointed by the court, Ms Justice Laffoy was told.
