AIB has judgment for €6.32m against four men

Businessman James Mansfield jnr has lost his appeal against summary judgment orders for some €6.32 million against him and others over unpaid loans to buy and develop lands in Co Meath.

Mr Mansfield argued he is dyslexic and cannot read properly and alleged he had signed documents, including an agreement with AIB concerning the loans, when he did not understand he was making himself liable for monies borrowed to fund the development.

The Commercial Court ruled in 2010 AIB was entitled to summary judgment for some €6.32 million against James Mansfield jnr of Palmerstown House, Johnstown, Co Kildare, and three others Brian Higgins Allensgrove, Celbridge Road, Leixlip, Co Kildare; Glen O'Callaghan, Drapier Road, Dublin and Seamus Kavanagh Kyle, Killea, Templemore, Co Tipperary. Mr Justice Peter Kelly ruled none of the four had made out an arguable defence to the bank's claim entitling them to a full hearing. Mr Mansfield appealed the decision but the other three parties did not.

The Court of Appeal dismissed Mr Mansfield’s appeal.
