THE petition for an examiner to be appointed to Butler Engineering and two other companies will be heard in the High Court tomorrow.

The case came before the President of the High Court, Mr Justice Costello, yesterday but he said it had been assigned to Mr Justice Keane, who was not available.

Mr Donal O'Donnell SC, for the petitioners, asked for an adjournment and the case was fixed for tomorrow.

The petitioner to Butler Engineering Ltd and Butler Engineering International Ltd, Lea Road, Portarlington, is Sureweld International Ltd, Fonthill, Lucan, Co Dublin. The petitioner to Data Inputs Ltd, a holding company of Northumberland Road, Dublin, is Sababa Ltd.

Last week the case came before Mr Justice Keane, when the petitioners sought an injunction restraining the receiver, Mr Ray Jackson, from acting as receiver until the court had heard and determined the petition for the appointment of an examiner.

Mr O'Donnell had stated that the petition was presented to the court on Monday, February 19th. The receiver had been appointed the previous Friday.

Mr Justice Keane granted the injunction until the hearing of the petition. He said there was absolute prohibition on the receiver from acting from the time of the presentation of the petition.

The judge then heard another application from two steel companies, the sole suppliers to Butler Engineering. Rathville Company Ltd, Dublin, and GCS (Steels) Ltd, a UK company, were granted an interim injunction that Butler Engineering should not use or dispose of steel in its possession under retention of title agreements made.
