The publication by the Irish Independent of information he had restricted has been accepted by Judge Kieran O'Connor as an error.
The judge accepted an apology by Mr Eoin McCullough on behalf of Independent Newspapers Ltd, as well as an explanation of how it happened, and an assurance on steps to be taken to avoid it happening again. Judge O'Connor, at Dublin Circuit Criminal Court, directed that a voluntary contribution of £5,000 by the company be passed to the Heart Foundation. Restrictions made by the court prohibit reporting the date or subject of the offending article.
