Lawyers for a Co Donegal nightclub owner who is taking proceedings against the State before the Court of Criminal Appeal, have been told to supply to the court's registrar within 48 hours a list of further documents which they claim they are entitled to from the State.

The Court of Criminal Appeal is dealing with an application on behalf of Mr Frank Shortt for documents to be used in preparing an application for a certificate that there was a miscarriage of justice in his case. An appeal by Mr Shortt against his conviction for allowing his nightclub to be used for the sale and distribution of drugs was not opposed by the DPP when it was before the appeal court last year.
