A Co Waterford accountant and the Irish Permanent plc, both of whom are alleged to have given references to a landlord on behalf of potential tenants, are being sued for almost £30,000 for claimed rent arrears and alleged damage to the landlord's south Dublin property.
Judge Michael White was told in Dublin Circuit Civil Court that Mr Pearse and Ms Delia Connell, landlords, of Bullet Road, Ballykiernan, Athlone, Co Westmeath, were suing Mr John P. O'Donohoe, trading as J.P. O'Donohoe & Co, accountants, Waterside, Waterford, and Irish Permanent plc.
Mr Gerry Ryan, counsel for the Connells, told the court that discovery of documentation against Irish Permanent and one of the tenants had already been disposed of and he was seeking an order for discovery against the second tenant.
Mr Sean O Siothchain, counsel for Mr O'Donohoe, told Judge White that a court order for discovery would be necessary to protect Mr O'Donohoe against any possibility of a breach of professional confidence in his dealings with one of his clients.
Mr O'Donohoe denies liability and has entered a full defence. Judge White granted an order for discovery of documentation relating to the tenant concerned.
