A federal judge has rejected a stay of execution for convicted Oklahoma City bomber Timothy McVeigh, who sought the delay after FBI officials admitted they failed to hand over 4,000 pages of documents.
McVeigh, who is scheduled to be executed on Monday, will appeal the judge's decision to a higher court, his lawyers said.
McVeigh's lead attorney Mr Rob Nigh told reporters after the hearing: "We are extremely disappointed ... As you are aware we have a lot more to do."
Mr Nigh said he would challenge US District Judge Richard Matsch's ruling with an appeal to the 10th US Circuit Court of Appeals.
McVeigh was found guilty of detonating the bomb that killed 168 people and injured more than 500 at the Alfred P. Murrah Federal Building on April 19th, 1995.
