Application in Carmody case adjourned
An application by the State to have the retrial of former Co Clare GP Paschal Carmody transferred to Dublin has been adjourned, pending the outcome of a High Court challenge.
Judge Carroll Moran was informed at Limerick Circuit Court yesterday that Mr Carmody, who is accused of defrauding terminally ill patients, has been given leave to seek a judicial review of the DPP's decision to proceed with a retrial on 11 charges.
Legal action over golf resort deal
A construction company that agreed a €14.7 million contract with another company for a golf resort development in Co Cork has brought court proceedings to prevent the other firm and its directors reducing their assets below €9 million.
Bowen Construction Ltd is seeking order against Kelcar Developments Ltd and three Kelcar directors, brothers Frank and Derek McCarthy, and John Kelly, arising from a contract of December 2004 between it and Kelcar for construction of the golf resort development at Tower, Blarney.
Mr Justice Peter Kelly adjourned the case to Friday.
Lynn employee seeks indemnity
A solicitor who worked in missing solicitor Michael Lynn's firm has brought a court action seeking to be indemnified by an insurance company against multi- million euro claims made against both Mr Lynn's practice and property firm.
The proceedings by Fiona McAleenan against AIG (Europe) Ltd were admitted to the Commercial Court yesterday by Mr Justice Peter Kelly, who said the action would run in tandem with other proceedings related to insurance companies that were denying cover for claims "arising from Mr Lynn's miscreancy".
