Smells from a Chinese restaurant were affecting the quality of life in a neighbouring family home, Cork Circuit Court was told yesterday. Judge Patrick Moran granted an interlocutory injunction for a week to Mr Donal Heffernan, of Ard na Ri Avenue, Pouladuff Road, Cork, against Mr John Chung, the Legend Restaurant, and landlords of the Property developments Concepts Limited.

The order restrains the defendants from allowing excessive fumes from the restaurant to drift into and around the Heffernan house.

Mr Heffernan, in an affidavit, claimed the family could not open windows during the restaurant's trading hours. Fumes still found their way into the house and were sticking to furniture and furnishings.

The trouble started when an extractor fan and grid was installed in the restaurant. The removal of an outlet pipe in April by the defendants had not deduced the excessive emissions.

Judge Moran also granted, Mr Seamus Roche BL, leave to bring a motion for judgment on Tuesday.
