A former ESB linesman patroller sustained severe injuries as a result of falling on hard-packed snow and ice while inspecting power lines after "a blizzard" in Co Mayo, it was claimed in the High Court yesterday.

Mr Stephen Lougney (45), of The Quay, Ballina, Co Mayo, is taking an action for damages against the ESB.

He claims he was not given proper footwear when sent out to inspect the ESB's power distribution line at Abbeytown in Co Mayo on January 5th, 1991.

As a result, he claims, he was caused to slip and fall heavily to the ground and sustained severe injuries. He had several operations and was also treated for depression. He was unable to return to work and was laid off permanently in 1992.

The ESB denies an accident occurred in the manner alleged or at all, that Mr Loughney suffered severe personal injury as alleged or at all and denies negligence.

If, which is denied, Mr Loughney suffered severe personal injury as alleged, the ESB says it was not caused or contributed to by the board.

It pleads Mr Loughney was guilty of contributory negligence.

The hearing is before Mr Justice Quirke.
