Developer has judgments against other properties

TAX ISSUES:THOMAS McFEELY, the former IRA prisoner who developed the Priory Hall apartments in Dublin, has had judgments registered against a number of his properties in recent times by the Revenue Commissioners and others.

Filings in the Registry of Deeds show the Revenue recorded a judgment mortgage against Mr McFeely and his business partner, Larry O’Mahony, in August of last year.

The judgment was registered against 2 Ailesbury Road, and 7 Shrewsbury Road, both in Ballsbridge, Dublin. The Ailesbury Road address is Mr McFeely’s home address. ACC Bank has also registered a judgment against Mr McFeely in relation to 2 Ailesbury Road.

In November 2009 ACC Bank obtained a judgment for €6.28 million against McFeely and registered it against a number of properties. These included property at the Plaza, Tallaght, 7A Fairfield Park, Rathgar, 3 Shrewsbury Road, Ballsbridge, 26 to 30 North King Street, 1 Holles Street, and 118 Thomas Street, all in Dublin.

Earlier this year Theresa McGuinness, with an address in Rush, Co Dublin, registered a judgment against Mr McFeely, Mr O’Mahony and Coalport Building Co, the company that built Priory Hall. Her judgment was registered against all of the above-mentioned properties as well as: 9/10 Fitzwilliam Street Lwr; 102 Upper Dorset Street; 32 to 34 Braithwaite Street; a premises at Connaught Street; an apartment on Connaught Street; 7 and site 27, Shrewsbury Road; 14 Clyde Road; 9 Zion Road, Rathgar; 11 Rathgar Road; 53 Rathgar Road; 69 and 70 Wellington Lwr; 42 Temple Road, Dartry; 14 and 20 Fairfield Road, Terenure; ground at Dubber Cross; 25 St Helens Road, Dún Laoghaire; units 1 and 3 The Olde Sawmills, Clondalkin; and 4 and 5 Colmcille Court, Swords, all in Dublin. The judgment was also registered against part of the esplanade in Bray, the Aquarium in Bray, and ground in Drumcliff, Banagh, Co Donegal.

Coalport is currently listed to be struck off in the Companies Registration Office. The last annual return filed was for the year to May 2009 and showed Coalport was owned by Tom and Noel McFeely, who had 50 ordinary shares each, and Derry-based Inis Developments Ltd, which held one A ordinary share.

The latest return for Inis Developments is for February 2011 and showed it was owned by a limited liability partnership called Tullyverry. The directors of Inis Developments were Thomas and Derek McFeely, with the latter having an address in Derry.

The members of Tullyverry at the time of its latest return were Derek and Thomas McFeely, Anton Richards Developments Ltd, with an address in Salford, England, and Richmode Ltd, with an address in Manchester. Both the companies are associated with the McFeelys.

The last filed accounts for Inis Developments showed guarantees given to the Bank of Ireland in 2007 and 2008, for £27 million and £15 million respectively. The former was signed by Thomas, Conal and Gerard McFeely, while the latter was signed by Thomas McFeely.
