Playboy told to provide Kate Moss photographs

Playboy Enterprises International must clarify parts of its claim against an Irish based entertainment website over alleged breach of copyright in publishing a link to exclusive photos of model Kate Moss "in various states of undress".

The Playboy company must also provide the photographs of the model for use in the litigation, Ms Justice Marie Baker said.

Ruling on a pre-trial application in the High Court, the judge said Playboy must answer questions raised about some of its claims by the operators of the entertainment.ie website.

Playboy must also provide the defendants with the photographs of Ms Moss used in the the magazine’s 60th anniversary edition which are at the centre of the claim.

The judge ruled certain other aspects of Playboy’s claim did not need to be set out in more detail.

Playboy Enterprises International Inc, part of the magazine empire founded by Hugh Hefner, has sued Entertainment Media Networks, which offers entertainment listings on entertainment.ie.

Playboy claims entertainment.ie had in December 2013 published a link to images of Ms Moss, which it had exclusively commissioned, a week before the 60th anniversary edition was published.

In its High Court proceedings for damages, Playboy claims the defendant caused it significant loss and damage and damage to its reputation by publishing the images.
