Pensioner withdraws damages action over slipping injury

A pensioner who claimed he broke his leg due to slipping on a badly repaired footpath while clearing snow and ice from outside a neighbour’s house has withdrawn his High Court action for damages.

William Moran (76), sued Fingal Council Council over the incident on December 8th, 2010 at Sheepmoor Grove, Blanchardstown, Dublin.

The council denied his claims and pleaded he slipped on ice during the bad winter of 2010/11.

Mr Moran said he had cleared snow that day and was scattering salt to melt the ice when he tripped on an uneven pathway outside the neighbour’s house.

He claimed the pathway was left in that condition as a result of footpath repairs carried out some years earlier on behalf of the council.

When the case was due to resume on Tuesday, Mr Justice Michael Hanna was told by counsel for Mr Moran it was being withdrawn.
