A LEGAL action against Primark over alleged infringement of design rights in various soft furnishing products, including duvet and cushion covers, may be settled, the Commercial Court was told yesterday.

The Ashley Wilde Group Ltd, with registered offices at Welham Green, Hertfordshire, England, brought the case alleging infringement of its copyright in the design “Boulevard”.

It was claimed Primark, on a date unknown, had begun selling duvet covers, lamp shades, ready-made curtains and cushion covers bearing the “Boulevard” design.

It was also claimed Primark did not dispute that assertion and and had ceased to stock items bearing the design from February 2009. Primark had declined to undertake not to reintroduce the products to its outlets, it was claimed.

When the case came before the Commercial Court yesterday, Mr Justice Peter Kelly was told there had been talks between the sides and it was hoped the matter would be settled. The judge adjourned the matter for mention to next Monday.
