Assault charge follows fatal stabbing

A 19-year-old youth has been charged with assault in relation to the death of a 41-year-old man in Drogheda early on Sunday.

A 19-year-old youth has been charged with assault in relation to the death of a 41-year-old man in Drogheda early on Sunday.

Desmond Kimmins from Ballsgrove, Drogheda, died in Our Lady of Lourdes Hospital, Drogheda, after being stabbed in Rathmullen Park in the town.

Keith Cunningham (19) of Halpin's Terrace, Drogheda, appeared before a special sitting of Drogheda District Court on Monday afternoon.

He was charged with assaulting Desmond Kimmins, a father of two children, causing him harm at Rathmullen Park on December 30th.

The charge is contrary to Section 3 of the Non Fatal Offences Against the Person Act.

Garda Tracy Brennan gave evidence of arresting and charging Mr Cunningham with the alleged offence at Drogheda Garda station on Monday.

In reply to the charge, Mr Cunningham said: "no comment at the minute".

In court, Insp Michael Cowley sought a remand in custody and told Judge Flann Brennan there was a probability of further, more serious, charges being preferred when the DPP considers a file on the matter.

The remand in custody was not objected to by the defence solicitor, Patrick Goodwin.

Judge Brennan then adjourned the case until Friday next, to be heard at Drogheda District Court.

A large crowd had gathered outside Drogheda courthouse during the proceedings.
