An appeal by the DPP against an "unduly lenient" three-year jail term imposed on human rights campaigner Vincent McKenna for sexual assaults on his daughter was again adjourned at the Court of Criminal Appeal yesterday as legal argument continued on whether the appeal was served within 28 days of sentence.

It was agreed to adjourn the case to next Wednesday to give the court more time to consider the legal implications of the argument by Mr Michael O'Higgins SC, for McKenna, that the appeal was not served, as required by legislation, within 28 days from the date of sentence.

Mr O'Higgins claims the time for service of the appeal had expired by a day before it was served and that the DPP's notice of appeal was served on the 29th day after sentence.

Counsel for the DPP has disputed that claim.
