Hearing date set for one of five teens accused of sex with girl (15)

One of the five teenagers accused of having sex with a 15-year-old girl at a house party had a new hearing date set for him on Friday by Tallaght District Court.

The court previously heard it will be alleged that as the girl was in her bedroom with the fourth teen, she heard a male voice say outside “get in line”.

The 17-year-old, of Rathfarnham, Dublin has pleaded not guilty to having sexual intercourse with a girl under the age of 17 at an address in Rathfarnham on March 14th, 2014, contrary to Section 3 (1) of the Criminal Law (Sexual Offences) Act, 2006.

He was before Judge Bridget Reilly on Friday to set a new hearing date. His attendance had been excused.

Five weeks ago, his co-accuseds, an 18-year-old, a 17-year-old and a 16-year-old were sent forward for trial to the Circuit Court. Another co-accused (17) will be back before the court in three weeks. He may be dealt with under the juvenile diversion scheme.

The court previously heard it will be alleged that on March 14th, 2014, the injured party who was 15, left her home at 7pm and a bottle of vodka was purchased for her in a local Lidl. The girl drank the bottle and friends brought her home at 8.30 as she was drunk.

It will be alleged that an impromptu house party occurred at the house and that five males had sex with her. It will be alleged that before she had sex with the fourth male she heard a male outside her bedroom say “get in line”.

The injured party alleges that each of males had pulled down her leggings and underwear and had sex with her individually. She alleged that she was scared and could not “physically say no”, the court had heard.

Judge Reilly told the 17-year-old's solicitor, Conor McKenna, that a new hearing date had been set for July 25th next . It is expected to take a week to hear. Mr McKenna said his instructing solicitor was still awaiting disclosure. The solicitor for the Director of Public Prosecutions (DPP) said the disclosure would be forwarded to the solicitors office.

Judge Reilly remanded the teenager on continuing bail to June 20th next for mention.
